I will give Rush the benefit of the doubt with respect to the allegations that he bought drugs illegally. If he did, I hope that he is treated exactly as any other illegal drug abuser. Most users - not dealers - who face state charges get probation the first go round, and can often get the charges expunged - in Virginia they call it a "251 disposition."

I don't handle federal cases but do have a client who plead guilty in federal court to possession with intent to sell and got probation and the sentence expunged about ten years ago.
