I think that your points about whether we should see the attacks by extremist Muslims as war acts vs. crime are interesting. Traditionally, the term "war" was applied to armed conflicts between nations. True, we had a "War on Drugs" and such, but this one is different. It certainly would help to clear up the semantics. If we can have a meaningful definition of War which would include conflicts with underground organizations, then it would be appropriate to use this term for Al Qaeda - and outfits like them.

Perhaps, one criterion for the new definition should be that such an organization should be able - at least potentially - to cause massive damage to a nation-state and its citizens, and maybe even threaten its survival. In this case - especially with all the killing power which money can buy nowadays - the present conflict with extremist Muslim groups would qualify as war.
