Excellent point about the violation of federalism.

My husband is for the law. I oppose it, not on grounds of federalism, but because I think that the procedure should be available not only to save the life of the mother but also her health.

He is also opposed to the federal government sticking its nose into things that should be regulated by the states. So I will tweak him a bit about this.

I've been tweaking him (and others) about the violation of federalism by the so-called "Defense of Marriage Act."

Really, when push comes to shove, they aren't nearly as principled as they pretend to be. They don't want Uncle Sugar out of their lives, they just want him on their side.

As for how the Supremes will rule - you just read what I think about the so-called conservatives on the court. They're pretty much all the same. Federalism applies when they don't like the law, but they'll turn themselves into a pretzel to support the law when they like it.
