Ethanol producers receive a 5.2 cent per gallon tax credit. The energy bill would require refiners to DOUBLE the amount of ethanol they add to gasoline supply. Increased ethanol usage would cut the amount of tax dollars flowing into the highway trust fund.

Grassley wants to use general revenues to make up the shortfall. Thomas argues that the issue should be left until a later highway bill.

The pair have also been unable to resolve whether tax credits to encourage alternative energy production should be tradeable, and whether tax laws should encourage construction of new, cleaner coal plants and environmental upgrades to existing plants, Domenici said.

Additionally, Domenici said House negotiators insisted that producers of MTBE, a petroleum-based fuel additive blamed for contaminated drinking water in some states, be given liability protection while opposing a "reasonable phase down."

House members are also calling for a number of Clean Air Act amendments, he said, indicating that such measures wouldn't clear the narrowly divided Senate, where Republicans hold only a one-seat edge over 48 Democrats and a Democratic-aligned independent.
