My impression was that was what the Court had in mind. As long as they keep it informal, it's OK.

California doesn't have that Supreme Court option available. They passed "Prop 209" and made it illegal to discriminate on racial grounds in California. Of course, the Universities are doing it anyway. But now they are getting caught at it.

It is legal for Berkeley to let in low scoring football players, etc. They are just not allowed to do it on the basis of skin color.
