It seems significant to me that judge told the prosecution that they didn't have much of a case, although it squeaked by the minimum requirements. I would think that unusual, therefore meaningful.

my point wrt the estrich article was that she seemed to be saying she's a "bad victim" because she so neatly fits within the nuts and sluts "defense"

I didn't get the impression that Estrich was saying that nuts and sluts can't be raped, only that this case played into the hands of those troglodytes who still subscribe to that notion and thus was an unfortunate event and potential setback for those trying to overcome that attitude where it still exists.
