You have the worst possible facts; the worst possible victim; the worst possible case for maintaining privacy. The "nuts and sluts" defense has found its cover girl. what i wrote was she "she makes this statement as though a "nut" or a "slut" cannot be raped. " meaning that when she describes her as the "worst possible victim", and she then herself calls the alleged victim the "poster girl" for the nuts and sluts defense... as the reader my perception of her article is that are problems with her case being precisely that the young woman has had previous psychiatric care, ('nut') she had a consensual previous encounter ('slut') and of course to make matters worse, she is reporting a rape against a very high profile individual (loss of privacy)....such a person should really consider what? not report the rape because her particular case is so fraught with these difficulties? is susan suggesting she is making a false charge of rape or that merely since the case is so difficult she should never have come forward. i'm convinced that many, many women still do not come forward in rape cases despite the rape shield laws. and now because we have a "covergirl for the nuts and sluts" defense, meaning the case is so difficult the prosecutor "blew it" and shouldn't have proceeded with the charge? i just wonder, is it really because the case is so difficult or is it more of the high profile exposure it is getting? would susan estrich counsel an alleged rape victim to not press charges in a similar case without the celebrity aspect of the alleged perpetrator? to be fair to susan estrich, i believe she truly is concerned about the chilling effect this case will have on rape victims (most definitely those who are victims of acquaintance rape)coming forward, but be that as it may, i think it goes too far to say the case should not be brought because this woman has just that kind of baggage...her article in and of itself could be construed as having a chilling effect as such that a woman who was raped with similar "baggage" may decide upon just reading such a thing, it's probably better not to subject themselves the further victimization of the nuts and sluts defense. frankly i would prefer to see someone exonerated from a false charge of rape in a criminal proceeding with much higher standards of evidence than a civil lawsuit. in fact my feeling is that unless a person is actually willing to go the route of criminal prosecution of an alleged rape, they have absolutely no business bypassing the criminal justice system straight for the civil courts with such a charge as she also suggested in her article.
