No need to re-invent the wheel. The U.S. has fought many wars in many lands, and dealt with this issue for over 200 years. We've signed treaties, and joined international organizations, and voluntarily pledged to follow the rules we'd like other nations to follow. And, officially, we haven't renounced the treaties, or abandoned all our principles. Not officially.
What I propose, is very very simple: 1. Follow the letter and spirit of the Geneva Conventions. 2. Stop inventing these categories of UnPersons who are protected by no treaty. 3. The US Constitution, and U.S. courts, should extend to the entire American Empire, everywhere we hold de facto sovereign power, not just the land we have officially annexed. Beginning with Guantanamo.
We say we champion the Rule Of Law. Yet, we are steadily creating more and more areas, where there is no law, where the soldiers can act with impunity, without the restraints of any Constitution or treaty. |
