I've never advocated treating them as criminals (unless they meet the definition of war criminals under international law). I've always said they should be treated as POWs, protected by the Geneva Conventions.

We are following neither the letter nor the spirit of the Geneva Conventions, not in Guantanamo or Iraq or Afghanistan.

This is what every (yes, every) international organization has said. The Red Cross, every international human rights organization, they all agree: the U.S. is flagrantly, systematically, massively, in violation of treaties we have signed.

Further: by bullying and bribing all the world's small nations into opting out of the ICC, we claim the right to commit war crimes and answer to no one.

Further: Our leaders have committed numerous acts that, based on the standards of the Geneva Conventions and/or the Nurenberg Trials, are war crimes.
