The problem this poses for the death penalty, at least in this state, is that there has to be a finding that the sentence of death in a particular case is appropriate when the crime in question is considered in relation to other cases where the death penalty has, or has not, been imposed.

The argument that is already being made is that if a serial killer with 48 confirmed kills is not to be executed, how can you apply the death sentence to a person who killed two people.
