Bill allows jury option in parental rights cases

PHOENIX - Accused of a crime? Twelve people decide your guilt or innocence.

Hurt in a car accident? A jury of your peers says whether you get money in a lawsuit.

The state alleges you are not a fit parent and wants to end your parental rights? You can only make your case to the judge.

Those who say the state's welfare system is broken are offering numerous fixes. And one includes allowing a jury to determine whether a parent is fit.

In the special legislative session under way, a Child Protective Services reform bill would allow parents the option of requesting a jury trial during a hearing on termination of parental rights.

The proposal has support from both Democrats and Republicans and is likely to be included in the final legislation.

If it's approved, some experts see two outcomes: There would be a new check on the state's powers, but parents would still be likely to lose their cases.
