That is correct. They have human genetic structure but lack the essential characteristic that makes us ethically more valuable than tigers and bears. All other creatures excell us in one way or another: they are faster or stronger, or more agile, etc. Yet we put these creatures in stews and frying pans for our pleasure. Being fully human is not about having 5 toes, or about teeth, or about hair. It is about our consciousness.

When a person has the capacity for that consciousness (rather than merely the potential), then she is human in more than simply the biological sense.

Infants are not fully human, and some would argue they have no natural rights. However, they are likely wanted, and in any event are protected by laws enacted under democratic accord.

Where one consciousness is physically dependent on another consciousness then they have by their nature a different natural right than humans whom in nature have the right to life, freedom, and the pursuit of happiness. Freedom is not a natural right for those unfortunates whom do not naturally have it.

But you seem to be of the opinion that some unborn should be considered legal persons. If so...how is that to be determined...and who will play the grim reaper role?
