"The contract provision could make it far more expensive for Oracle to acquire PeopleSoft, as a successful takeover could trigger hundreds of millions of dollars in additional liabilities."

This was in the Reuters article of July 2nd that you posted. And yet, Oracle claims to have just found out about it recently in one of PSFT's government filings. They're obviously not doing very good due diligence WRT acquiring PSFT.

I'm confused on why the stock is not performing better today, a day the Nasdaq is up 36 pts. According to a Forbes article today:

"PeopleSoft (nasdaq: PSFT - news - people ) shares fell on reports that placed the likelihood of its prospective merger with Oracle (nyse: ORCL - news - people ) in further doubt. According to the reports, the U.S. Justice Department will probably oppose Oracle's takeover bid on anti-competitive grounds."

Actually the stock finally broke into the positive this afternoon, but I'm still confused: Oracle is only offering $19.50/shr, yet the stock is at $21.64 (as of right now). Why is it trading for more? And why did I buy it at $22.48? The answer for me is, I am betting that Oracle doesn't buy PSFT, and I don't want them to do so. I like PSFT at the current price without Oracle. So why does the stock go down on reports that weaken the Oracle proposed buyout?

Anyone with insight, please respond.
