Those are good points to clarify.

Utility is not a quantitative measure as is implied by it's ordinal nature. Comparison is a better fit.

Austrian theory would say that indifference cannot be the source of action.

True. Observe, in this instance, was limited to the theoretical construct - I should have been clearer with that.
