They could not (or at least should not). The mistake most people make is thinking legalization means lack of control. Far from it. Every legal business needs to be licensed and the requirements for that license is directly proportional to the harm they can cause (just imagine what your hospital has to put up with to run their business). The idea is to free the resources of fighting this losing war and allocate them to education, rehab, and monitoring of licensed businesses.
