What you are stating appears to be culled from "Motley Fool". I have never been impressed by those guys (other than for their skills at self-promotion) They have been inaccurate and wrong far too often. As someone who actually is educated in both finance and the law I would not accept such supercilious explanations for ASND's failure to meet expectations. No wonder DJ and First Call don't buy it. There is a legal maxim which instructs in cases of ambiguity. Ambiguity is construed against the drafter. Judging by how well the stock has performed since "earnings", I'll have to agree that others understand the merger issue as well, but not in the way you would wish. Regards
