Soitec, SiGen Legal Wrangling Comes to an End Electronic News, 12/2/2003 reed-electronics.com soitec.com Soitec will pursue its petition before the U.S. Patent Office to have Patent 564 reissued, as announced back in June, in order to eliminate any enablement problems, with respect to the claims concerned. When granted, the reissued patent will complement the intellectual property (IP) package already licensed to Soitec by the CEA. It includes revised claims that will clarify the enablement of the process using hydrogen alone or in combination with other gas ions in the implantation step to achieve layer transfer. These claims will profit from the same priority date and judicial precedents as that of the 564 patent. The enablement requirement may not have been met (yet) on paper, but the fact that SiGen was able to successfully copy the process demonstrates that they were enabled. Oh, I forgot, that's their own "innovative layer transfer process." So says their legal counsel. sigen.com Imo, it will be an injustice if SOITEC does not ultimately prevail. WT
