It is possible to sue foreign nationals in American courts if the court determines that it has jurisdiction. It certainly is more difficult than suing an American but the procedures are well established. The employer of the negligent Doc would normally be liable also, but it could get tricky if the foreign national was considered a subcontractor rather than an employee.

There are of course loopholes where US certified professionals approve (ruberstamp) the work done by foreigners.

That is a good point. I think it will ultimately prove very difficult to stem this trend of increased worldwide trade in services. I really see no economic justification for protectionist measures against free trade. The internet has made many services more mobile than ever before. Economics eventually trumps politics. Markets want to be free.
