GST,

Iraq is a country and no Iraqi's are held as enemy combatants (from the Iraq War).

Al-Queda is not a country and neither are the Taliban, hence the difference.

However, Saddam would not be a POW. As a head of state - he would not be afforded the protections associated with soldiers. He gave the orders, he did not follow them.
