I think a decent reform to the jury system would be to allow jurors to ask their own questions.......

My god! We agree. Though I don't have any idea what effect that might have. Having sat on a jury [litigation] I had questions that I wanted asked that weren't. On the other hand, after the trial, I asked the defendant's attorney why they didn't ask and she said on that particular question to the expert witness [paraphrase]..."he makes a good sum of money out of giving "expert" testimony on medical symptoms...there's no way he's going to jeopordize his income." Would have it done any good, if I had the opportunity to ask the question....probably not.

As an aside...our jury awarded, medical expenses fully covered; $1 for pain and suffering and $0 in punitive damages.

1. Most lawyers are afraid of going to trial.....I often use this reticence to my advantage.

2. Most parties are willing to settle because they are pressured by their lawyers to do so....


When I do find little bits and pieces of data, it seems to support the position that the torte system is working pretty well, or at least not broken. It's unreasonable to take one case which "appears" to be an injustice and extrapolate it as if it was the norm.

Do you have access to any data bases that might shed some additional light on the subject?
