Hi, Pat -

"...will discussion now be any less relevant than it was a week ago. Ditto for numbers."

We've had discussion for 7 years or more for some, 3 years for me and you. What difference has it made?

Show me one poster who's been consistently right about Dimethaid. There's not one. The bashers have been closest by far, but not even GRSTYLE had it right.

Everybody has been wrong. Scottcl referred to the "extreme polarization of views" and the difficulty of interpreting what the available evidence on Dimethaid means.

Forget the Provalis decision, and the fact that it removed any cushion Dimethaid had from its latest funding. Forget whether it's fair to RK. I happen to agree with those who believe Dimethaid got screwed by the arbitration: the result was not consistent with what we know. But what do we know? My opinion, or anyone else's, is irrelevant. Because the arbitration can't be appealed. It's over, and investors have to live with the result. So does RK. Was it another RK gamble, after the initial Provalis mistake, or was it a justified legal move?

Who cares? Opinion is irrelevant.

Disregard opinion for the moment, and look at the numbers. The numbers say RK must go. Forget what you think, what I think, what the institutions think, what anyone thinks. Just look at the numbers, and what they say about next November.

The numbers tell a story completely independent of opinion.

They say she can't get WF10 out the door, for at least another year - or more. They say that Dimethaid will continue to limp for another year, even if it goes cash-flow positive.

The numbers say that by next November, Dimethaid will still be a one-trick pony, with its hand out again, to fund development that should have been accomplished long ago. The numbers say that R&D will grind to a halt.

Yes, FDA could happen in the meantime, and save RK. Do we want to spend a year in the deep freeze, praying to be saved by an approval that may not come? It may be someone's opinion that FDA will happen, but who knows?

With all due respect, Pat, opinion is now irrelevant. Whether the Provalis decision was fair or not is irrelevant. Whether RK could have done it, would have done it, or never could have done it, is irrelevant. Whether this poster or that poster supports RK or not is irrelevant.

What do we know? What is obvious and indisputable? What is not a matter of opinion?

The numbers. They say RK must go.

Regards,

Jim
