If we are in a state of war, the prisoners are prisoners of war.

POW status is not determined by a declaration of war.
To receive POW status, the Geneva convention requires that prisoners, or "detainees," meet the following criteria:

Wear a distinctive uniform or insignia or dress to clearly identify the combatant as a part of an organized unit.

Carry arms openly.

Be a part of an organization that has a commander.

Obey the laws of war.


It is quite clear to me that al qaeda does not live and operate within the international rules designed to afford them protection if captured.
We need to keep the monkey on the right back...aq's failure to adhere to the established rules of war is their problem not ours.
