Your original point was, pardon my "paraphrase," that liberals and Democrats, who revere FDR, are hypocritical in their criticism of the current Administration policy and that they hate Bush and Ashcroft so much they're prepared to let a terrorist free among us out of spite.

I thought that was over the top, a gratuitous and not particularly astute swipe at liberals and Democrats in general, not to mention FDR, and that's why I called you on it. I imagine that there are some lefties who are dumb or deranged enough to react that way, but your typical liberal surely isn't.

My understanding of what this Padilla thing is all about is a process of determining how we distinguish between and handle common criminals and enemy combatants in this new terrorism paradigm. It is a legitimate and important question.

The Administration took the first crack at it and ended up holding Padilla as an enemy combatant. The second step was for some civil liberties interest group (an interest shared by both ends of the political spectrum) to take that to court. The court rules, the loser appeals, and so on and so forth until we end up with a determination. The matter is far from settled. It's way too early to get your shorts in a knot. The players are playing out their advocacy roles in the process. Each takes his best shot. That's how we sort things out in our system. The bottom line will be something that both protects the rights of citizens and national security as best they can be protected. Maybe some laws will need to be amended. Maybe some attitudes will have to change. Over time, something of a consensus will form around whatever we end up with. There's no need to demonize the advocacy players for doing their jobs. It's most unlikely that Padilla will walk if he was up to no good. Those who took this to court would likely be as horrified as you or I if that happened. There's a natural ebb and flow in these processes. That's how we reach equilibrium.
