I haven't read the opinion in the Padilla case, but from what I've heard about it, I agree with the dissent, that Padilla deserves a hearing on whether he is, in fact, an enemy combatant. He's been held a very long time as it is, in light of the fact that he is presumptively a US citizen, and if so, entitled to the full panoply of constitutional rights.

If he has that hearing, and loses, then Bush and Ashcroft have nothing to be ashamed of. But if he wins . . . . it looks really bad. Further delay is unseemly.
