Otherwise why would the Iraqi Council and the US form the tribunal just days before Saddam's capture. The timing is very suspect

We may never learn if the timing was merely co-incidental to the capture. On the face of things, this is the easiest explanation.

What seems to be increasingly indisputable is that Saddam was not in that pit due to his own free will.
