Is FICA a Scam ?

This afternoon, I had a chat with a friend of mine in New Zealand - he worked in the US for 3 years, and when his visa expired, and the job was 'surplus to requirements', he went home. During those 3 years, his paycheck deducted FICA. He has no idea if he can work in the US again, or claim at least part of his FICA contributions at the appropriate time.

Is the US not scamming transient workers (who are legal in the country, BTW), by not giving them control of their FICA contributions ?
