Lots of people pay FICA and never get to claim anything. That's the way the system works. You need forty quarters to be eligible. I've paid FICA but I will never collect. As long as the rules are published and followed, I don't see how it can be considered a scam. A lousy approach to retirement, but not a scam.

P.S. Some people tout this as an side benefit of illegals. They contribute to FICA but will never collect, thus paying indirectly for the services they get.
