The UN had an armistice with Iraq.

And Iraq was declared in material breach of the terms of that armistice in November, 2002 by the UNSC (1441 passed unanimously).

Thus, the operative word at the time Bush overthrew Saddam was "HAD".. That armistice effectively ceased to exist at the end of the 90 period following 1441, after there was no action by the UN to declare that Iraq had resolved it's material breach.

It was at that time that Bush, leading a coalition of other UN members, including the US, enforced and resolved that material breach.
