Jain's suit won't go very far. If he does manage to get it to a trial with a favorable verdict, damages will be awarded based on demonstrable economic damage. Since his business was only a month old when Infospace sued and could only have had an insignificant amount of business if any, the harm Infospace may have inflicted would be negligible.
