I'm not sure I follow the question, Shep. The issue here does not have to do with the practical application of capital punishment. It has to do with the philosophy that supports the right of the state to defend itself in cases of murder. It assumes the existence of murder and posits that where murder exists, capital punishment is an acceptable retribution.
