I agree with Ginsburg to this extent: it is necessary that issues concern the balance of rights and security be debated honestly to ensure a satisfactory outcome. I approve, for example, of judicial review of issues flowing from the Patriot Act. However, I do not think that the Patriot Act is a special threat to civil liberties.........
