I think this is going to be a problem for prescription drugs, in the internet age there is no way to enforce it. They can police for controlled substances, but most prescription drugs are not controlled substances, so the Fed has no interest in it. And the states have no capacity to police it. Two aspects to this: (1) forget about patents on drugs; and (2) forget about going to the doctor with your sinus infection, just order up some anti-biotics and have them delivered FedEx.
