Dear Joe I hope the euphoria has begun to wear off, because these are the grim facts. (per your post # 1378, item 4) 2.2 million remaining of the floorless convertibles. sounds like a big fat law suite. Sure the lawyers from Exsorbet will get to use discovery to uncover the grim facts...but remember these are offshore investors(Reg S not Reg d). Will our lawyers be able to prove fraud in a court of law? remember also that the court could force performance(i need to reread the contract). (5) What kind of a plan? The damage has aready been done. We might be able to collect some damages. the big problem with this notion is the shares have already been issued and changed hands many times. (6) Are these the kind of people(Shaar Fund) we want to do business with? Remember they did get caught with their hands in our cookie jar. i didn't know they were in ithe insurance business more to follow.... regards dave u
