I think you have it backwards, given what mph said. The average Joe would have probably taken the deal. That way, not only would he avoid further costly legal battles, he could also avoid being a convicted felon just by obeying the terms of the deal.

Rush and his lawyers, on the other hand, can afford to fight all the way. But just because he can doesn't mean he necessarily should, unless there's some other reason involved. Ego? Principle? Ah, who knows?
