The "property rights" I am referring to are the ones from each party of the Marriage. Dowerys, etc.

We don't have any "right" to Marriage under the Constitution, Steven. Only as regulated by the State. You have to get a License. If you and I lived in the Libertarian Society you are postulating, we could hire a "Contract Engineer" to take care of things for us. That's the title I figure Lawyers would end up with in my nice little "never never" land.

But in our real world, it is a Political decision, and not one that the Courts should be making. It may be a good outcome, but it's bad law from a court. And it may well end up backfiring and causing the passing of a Constitutional Amendment.
