It does. They should be analyzing the whole institution of civil marriage in the light of all the changes over the last decades and reinventing it appropriately. They are not doing their jobs if they just let old marriage laws ride.

I believe the courts in this country have no respect for the people, democracy, or the constitution.

Legislatures can be pretty cavalier about the constitution. When they are, the courts are there to remind them of it. It's part of their job to rule on the constitutionality of legislative acts. Do they do that well? Not necessarily and not always, but that's the failing of judges, not an indictment of the role of the courts.

There is an inherent conflict between democracy and the rights given to us all by the Constitution. The courts are there to deal with that. I don't understand why so many folks don't get that. We may take issue with particular rulings, but the role the courts play is for our benefit and in support of the Constitution, not contrary to it.
