I imagine the case would be brought based on an equal protection argument. The plaintiffs will, imo, be able to establish that they are being denied equal protection under the law. The issue well then be whether there is a compelling state interest in denying gay people equal protection.

Hopefully it won't come to that and an adequate political solution to the problem can be found.
