So your choice is to make a statement and jump off before you even make an effort to support it with facts. Yes, that is disappointing, and boring. (And as I said, I am familiar with the older case law in this area- and I googled to try to find newer cases that said exactly what you said the case law said- but could not find them. Granted I did not spend hours on the job- but if you have cases that speak to the points I raised I would like to see them. If you cannot produce them, well, that makes your argument look quite unsound.)
