Congress represents the American people (well, at least in theory), so when Congress passes something I think it is fair to say it is the act of the American people.

If I own a restaurant, the Constitution does not require that I allow black people to eat there or use the restrooms. If I own a private school,, the Constitution does not require me to allow black people to study there. If I own a department store, the Constitution does not require me to allow black people to shop there.

These are all rights that were granted not by the Constitution, but by the American people. So, when you say that but for the Constitutions only white males would be allowed to vote, you forget the very generous and totally voluntary decision the American people made in 1964 to grant black people these rights.
