How can you say otherwise? Congress did not have to vote in favor of the Civil Rights Act of 1964, and absent that act, black people would not enjoy many of the rights they possess.

There is no question that these rights were granted to black people by Congress, and that they are not rights granted by the Constitution. They are rights granted by the electorate, and at the time the electorate consisted primarily of white people, and Congress consisted exclusively of white people.
