That will take some time. Time is what this needs to sort itself out. If it is found unconstitutional, by then we will have some experience with this thing and likely a more thoughtful approach to an amendment, if needed.

A gay couple married in Ca accumulates some property there which is community property under their laws, moves to New York where they don't have community property and accumulates some property in the name of one of the parties, then comes to Washington, another community property state, and accumulates more property. Then they split up and one files for divorce.


Er, just what they would do with a heterosexual couple under the same circumstances, no?

And that doesn't even begin to consider what would happen if they were a lesbian couple and one of them had a child.

And we don't now have complications with lesbian couples and children?

Chris, this is why we have state legislatures and state courts. They've worked their way thought all sorts of changes already. They've already figured out divorces and child custody for regular marriages and then common law marriages and then non marriages. This is a drop in the bucket.

When environmental regulation shifted from national standards to state standards the courts and the legislatures and the lawyers all had a job to do. I don't recall anyone ever fussing about what a mess that would be. Some with the breakup of the phone monopolies. Goes with the territory. Hardly the end of the world.

Personally, I don't mind if some lawyers get rich protecting federalism.
