Tonto, it sounds like the criminal matter will be dealt with before the civil one will, since the 10q indicates that the civil matter was stayed pending the outcome of the criminal matter. This is not unusual since a party has a right not to self incriminate in a criminal matter, and has no such right in a civil one (ie Hsu and others will be compelled to testify in the civil matter). I am a little bit confused about the 10q, though, since it indicates that the aug 12 hearing was an appeal of the denial of the preliminary injunction. I had thought it was the commencement of the criminal trial. It seems inconsistent that a civil matter that was stayed by one judge could be appealed with respect to the preliminary injunction, unless the injunction matter was not stayed. In any event, does anyone have any information as to what happened on the 12th? If, as was described in the 10q the appeal was argued, but no decision rendered, we could be waiting a long time for any development that would impact on the stock price. |
