Saw David Boise (a great attorney, perhaps the best in the country) on Charlie Rose last night, and he laid out a very chilling portrait of what happened to Martha Stewart.
When she went in to talk to the Feds, the FBI was there, Justice was there, the SEC was there, and, incredibly there was no transcript, no audio tapes, no video tape of her questioning and of her statements. Boise said the nuances of what she said are lost, and what is left is the spin put on her statements by the Government. --------To me that is pretty scary. I don't know if she even had Legal Council in the room. Her original Attorney was some friend who was a lawyer for MSO.
Boise said, "never, ever, talk to the Government without a transcript ." And he said when the Feds say, "we are here to help you," run the other way.
Boise also said that had she told the truth that day she probably would have gotten off with a minor fine. So, Martha's BIG crime was lying to the Government.
As if the U.S. Government never lies to the people. Vietnam comes to mind. |
