Stew,

I follow you on everything except the issue of Tivo's Showcases. It's very nice having you back in the discussion and I'd appreciate further help regarding the following.

1) Even though Tivo is providing Showcases to Gemstar, what requires the carrier to use Gemstar rather than another enabler to access the Showcases?

2) What bearing does the Tivo/Gemstar agreement have on any other company that provides Showcase-like products to the carrier?

Although not exclusive in terms, I'd consider prepayment (especially when done in the hundreds of millions) as a fairly solid argument as to intentions.

I agree that it's "fairly solid" as you say, but not a lock. As an example of a lock, I think of the Sony agreement that requires payment to Gemstar for any device shipped (I can't remember if there was a geographic limitation) with a guide, whether it's Gemstar's guide or not. The agreement with Microsoft is similar.

There is also the added perspective, if I remember correctly, that Echostar, Comcast and Microsoft are the only companies that pre-paid. All of the others agreed to pay-as-you-go arrangements. (The Microsoft agreement is a combination of the two.)

Actually, the agreement I like best in some ways is the JV agreement with Comcast. It's a qualitative issue that can't be quantified. As a leader in the cable industry, I sure do like the idea of the company's investment and ideas being integral to development of the final product.
