Found the speculation...seems reasonable...lol

"Here's what will happen. Rehnquist retires. Thomas or Scalia becomes Chief Justice. The right-wing exerts its influence to nominate a conservative extremist for the vacant spot. Democrats successfully filibuster. By a vote along party lines, Republicans change the rules to give themselves the power to end the filibuster by a simple majority vote. Democrats sue on the ground that rules designed to avoid the tyranny of a bare majority can't be changed by the vote of a bare majority. The case goes to the Supreme Court which (no longer having Rehnquist's vote) deadlocks 4-4. To end this state of constitutional crisis, Bush declares martial law, suspends the Constitution, repeals all taxes (except those imposed on incomes of up to $50,000 earned by working people), and declares himself President for life. The news channels all proclaim Bush to have been a masterful strategist and his approval ratings soar.
