Dietl said it made no difference whether or not the plot was carried out, telling Crowley, "By just talking about it, it's the crime of conspiracy."


That's an absolutely incorrect statement of the law. You have to have an agreement among the conspirators and an overt act in furtherance of the conspiracy. "Just talking about it" is not enough.
