Any gaming facility,(Native or otherwise) has to be approved by the State Legislature...However if refused, the tribe in question can deal directly with the US Secretary of the Interior thereby effectively sidestepping the local authority...I am not sure but I believe that most of the tribes try to avoid confrontation and prefer to deal with the state authority, while all the while they both know there is another way...Check out the site below for more information.
