Actually, as I recall, my thought at the time was, had I found AS had been banned, I would have deleted the thread without further consideration and despite what it may have done to the site's performance over the ensuing hours.
You asked elsewhere, "I took this to mean that posters banned from a thread could not be discussed, attacked, or ridiculed on that thread. Is this a correct interpretation of your meaning?"
No. It's never "okay" to attack a user. Well, it's very rarely okay.
It's never okay to break the posted speed limit. Yet we do it every day, with the foreknowledge that at any time a peace officer might decide to cite us for speeding. When that happens, we don't defend it by saying we speed here every day, or by claiming that everyone does it too. Oh, we can try, but at the end of the day we pay the piper.
So, just because this stretch of slippery slope isn't being actively patrolled today doesn't mean it won't be tomorrow. If you abide by the posted TOU, you've got no worries. If you don't, do so with the knowledge that the piper may come calling at any time.
"Officer, why are you ticketing me? I was going the same speed as everyone else!"

"I'll also be citing you for running that stop sign, Sir."
"But, officer... I run that stop sign every day!"
