Very true. And for Intergraph they specifically tried to get court orders to preclude such activities.

However, a larger company (say HPQ) wouldn't have this concern. So can Dell get any especially valuable special treatment (as many suggest) which another Tier 1 couldn't legally challenge? While some degree of favoritism could be reasonably supported through subjective 'criteria' anything substantial would seem highly questionable.

For companies starting up or mid-sized I would think this potential critical reliance on a single source would be a prohibitive risk and one that might be mitigated by either electing not to use this type of supplier or to develop a mixed supplier model ASAP.
