As I understand it, there are three significant legal consequences of not being covered by the Geneva Conventions which matter here -- 1) unlike prisoners of war, they can be interrogated; 2) unlike prisoners of war, they can be prosecuted as common criminals; and 3) unlike prisoners of war, they cannot expect to be repatriated at the cessation of hostilities.

I am not aware of any cogent legal argument for treating members of Al Qaeda as if they were entitled to any of these 3 particular legal protections. Perhaps you can advance one.
